01 Acceptance of Terms
By accessing our website or submitting your details, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our services.
02 Service Description
The D.E.A. provides AI-powered automation services including lead capture, email and SMS follow-up, appointment scheduling, review generation, client onboarding, AI voice agents, and AI employees or autonomous agents. Services may be deployed through third-party platforms integrated with existing business systems.
03 Permitted Use
You agree to use our services only for lawful business purposes, provide accurate information, avoid copying or reselling materials without written permission, and comply with applicable laws including CAN-SPAM, TCPA, and AI disclosure requirements.
04 SMS Messaging Program
By opting in, you agree to receive recurring marketing, informational, and transactional text messages from The Digital Executive Agent. Message types may include appointment confirmations, reminders, lead follow-ups, service updates, promotional offers, and related communications. Consent is not a condition of purchase.
You may cancel the SMS service at any time by replying STOP, CANCEL, END, QUIT, UNSUBSCRIBE, or STOPALL. For help, reply HELP or contact us through the Contact page or by calling 917-935-4358. Message and data rates may apply, and message frequency varies.
05 AI Systems Disclaimer
AI chatbots, voice agents, and AI employees are tools designed to support business efficiency. They may occasionally produce inaccurate or incomplete outputs. Client-facing AI communications should be monitored, and high-stakes decisions require human review. We do not guarantee specific financial outcomes from automation.
06 Intellectual Property
All content, code, automation templates, workflows, playbooks, and materials are the intellectual property of The D.E.A. or its licensors. Reproduction without written consent is prohibited.
07 Pricing, Payments & Subscriptions
Fees are billed upfront on a recurring monthly basis unless otherwise stated. A one-time setup fee may be due at onboarding. Cancellations must be submitted at least seven days before the next billing cycle. Refunds are handled at our discretion and only in cases of service failure. AI agent API costs may be billed separately for Enterprise plans.
08 Limitation of Liability
The D.E.A. shall not be liable for indirect, incidental, or consequential damages, loss of profits, data, or business interruptions arising from use of our services, including errors in AI-generated outputs.
09 Security Responsibilities
We implement encryption, API key rotation, two-factor authentication, and access controls. Clients are responsible for maintaining the security of their own platform credentials and complying with industry-specific regulations.
10 Termination
We may suspend or terminate access for breach of these Terms. All intellectual property rights and payment obligations remain enforceable after termination.
11 Governing Law
These Terms are governed by the laws of the State of New York, United States.
12 Modifications
We may update these Terms at any time. Changes take effect upon posting, and continued use indicates acceptance.
