These Terms govern your access to and use of The Digital Executive Agent's website, AI automation systems, AI agents, and consulting services. By using our site or services, you agree to these Terms.

01Acceptance of Terms

By accessing our website or submitting your details, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our services.

02Service Description

The D.E.A. provides AI-powered automation services including but not limited to: lead capture, email/SMS follow-up, appointment scheduling, review generation, client onboarding, AI voice agents, and AI employees (autonomous agents). Services are deployed using third-party platforms (GoHighLevel, Make.com, n8n, Vapi, etc.) integrated with your existing business systems.

03Permitted Use

  • Use our services only for lawful business purposes
  • Provide accurate and truthful information
  • Do not copy, redistribute, or resell any materials without written permission
  • Comply with all applicable laws including CAN-SPAM, TCPA, and AI disclosure requirements

We reserve the right to suspend or terminate services for misuse.

04SMS Messaging Program

Program Name

The Digital Executive Agent SMS Program

Program Description

By opting in, you agree to receive recurring marketing, informational, and transactional text messages from The Digital Executive Agent. Message types may include appointment confirmations, appointment reminders, lead follow-ups, service updates, promotional offers, and other communications related to our services.

How to Opt In

You may opt in by completing a form on our website that includes a clearly-labeled SMS consent checkbox, by texting an opt-in keyword to a published phone number, or by providing verbal or written consent in a documented interaction with our team. Consent to receive SMS messages is not a condition of purchasing any goods or services.

How to Opt Out

You can cancel the SMS service at any time by replying STOP to any message we send you. After you send STOP, we will send a single confirmation message acknowledging your opt-out, and you will not receive any further SMS messages from us. The following keywords will also opt you out: CANCEL, END, QUIT, UNSUBSCRIBE, STOPALL.

How to Rejoin

If you have previously opted out and would like to rejoin the SMS program, you may sign up again through any of our opt-in methods. Once you re-opt in, you will resume receiving messages.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Message & Data Rates

Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. Contact your wireless provider for information about your text or data plan.

Privacy

For information about how we handle SMS opt-in data, please review our Privacy Policy. Mobile opt-in data and SMS consent are never shared with third parties or affiliates for marketing or promotional purposes.

Compliance with Industry Standards

This SMS program complies with the CTIA Messaging Principles and Best Practices, the Telephone Consumer Protection Act (TCPA), and applicable mobile carrier requirements.

05AI Systems Disclaimer

Our AI chatbots, voice agents, and AI employees are tools designed to support business efficiency. They may occasionally produce inaccurate or incomplete outputs. All client-facing AI communications should be monitored, and high-stakes decisions require human review. We do not guarantee specific financial outcomes from any automation.

06Intellectual Property

All content, code, automation templates, workflows, playbooks, and materials are the intellectual property of The D.E.A. or its licensors. Reproduction without written consent is prohibited.

07Pricing, Payments & Subscriptions

  • Fees are billed upfront on a recurring monthly basis
  • One-time setup fee of $500 due at onboarding
  • Cancellations must be submitted at least 7 days before the next billing cycle
  • Refunds are handled at our discretion and only in cases of service failure
  • AI agent API costs (voice minutes, LLM tokens) may be billed separately for Enterprise plans

08Limitation of Liability

The D.E.A. shall not be liable for any indirect, incidental, or consequential damages, or loss of profits, data, or business interruptions arising from use of our services, including errors in AI-generated outputs.

09Security Responsibilities

We implement encryption, API key rotation, two-factor authentication, and access controls. Clients are responsible for maintaining the security of their own platform credentials and complying with industry-specific regulations (HIPAA, SOC 2, state bar rules, etc.).

10Termination

We may suspend or terminate access for breach of these Terms. All IP rights and payment obligations remain enforceable after termination.

11Governing Law

These Terms are governed by the laws of the State of New York, United States.

12Modifications

We may update these Terms at any time. Changes take effect upon posting; continued use indicates acceptance.
