These Terms govern access to and use of The Digital Executive Agent website and Your new voicemail. By using the site or the service, you agree to these Terms.
01 Acceptance of Terms
By accessing our website or submitting your details, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our services.
02 Service Description
The Digital Executive Agent provides a replacement for business voicemail. When you cannot pick up, the line answers, takes the message, writes a short summary, and texts or emails the right person. Booking, common questions, reminders, and review asks are optional settings on the same line.
03 Permitted Use
You agree to use our services only for lawful business purposes, provide accurate information, avoid copying or reselling materials without written permission, and comply with applicable laws including CAN-SPAM, TCPA, and AI disclosure requirements.
04 SMS Messaging Program
By opting in, you agree to receive recurring marketing, informational, and transactional text messages from The Digital Executive Agent. Message types may include appointment confirmations, reminders, lead follow-ups, service updates, promotional offers, and related communications. Consent is not a condition of purchase.
You may cancel the SMS service at any time by replying STOP, CANCEL, END, QUIT, UNSUBSCRIBE, or STOPALL. For help, reply HELP or contact us through the Contact page or by calling 917-935-4358. Message and data rates may apply, and message frequency varies.
05 Automated answering
The line is an automated answering service. Callers are not speaking to you. We tell them they have reached your business line. We do not guarantee a human will pick up, and we do not guarantee a specific number of jobs, bookings, or reviews.
06 Intellectual Property
All content, code, automation templates, workflows, playbooks, and materials are the intellectual property of The Digital Executive Agent or its licensors. Reproduction without written consent is prohibited.
07 Pricing, Payments & Subscriptions
Fees: There is no setup fee. Your new voicemail is $149 per month. The line is $299 per month. We may change monthly prices with 30 days’ notice.
Cancel: You may cancel at any time. Email us or tell us on a call. Billing stops at the end of the current monthly period. There is no cancellation fee and no requirement to give seven days’ notice.
Refunds are handled at our discretion and only in cases of service failure.
08 Recordings
Recordings: Call recordings and summaries are stored while your plan is active. After cancel, we delete them within 30 days unless the law requires us to keep them longer.
09 Limitation of Liability
The Digital Executive Agent is not liable for indirect, incidental, or consequential damages, loss of profits, data, or business interruptions arising from use of the site or the service, including errors in a summary, recording, or message we send.
10 Security Responsibilities
We implement encryption, API key rotation, two-factor authentication, and access controls. Clients are responsible for maintaining the security of their own platform credentials and complying with industry-specific regulations.
11 Termination
We may suspend or terminate access for breach of these Terms. All intellectual property rights and payment obligations remain enforceable after termination. Cancel stops future monthly charges. You still owe any unpaid invoices for time already used. You will not be billed for months after the cancel date.
12 Governing Law
These Terms are governed by the laws of the State of New York, United States.
13 Modifications
We may update these Terms at any time. Price changes take effect 30 days after we notify you. Other changes to these Terms take effect when posted, except that a change which adds a fee does not apply until the 30 days have passed. Continued use indicates acceptance.
